By accessing or using the Services, you agree to be bound by this Agreement.

We reserve the right to modify these terms at any time. Material changes will be communicated to users via email or through the Service with 14 days advance notice. Continued use of the Services after such changes constitutes your acceptance of the new terms.

2. Services Provided

Our platform provides comprehensive data breach monitoring services including:

  • Email breach lookups across 10+ billion breach records
  • Continuous monitoring and real-time breach detection
  • Automated alerts via email, Slack, Teams, and webhooks
  • Comprehensive breach information and threat intelligence
  • API access for integration with existing security tools
  • Domain monitoring tools for organizational security
  • Executive dashboards and compliance reporting

3. Account Responsibilities

  • You must maintain accurate account information at all times
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must not share account access with unauthorized parties
  • You accept full accountability for all activities that occur under your account
  • You must report any unauthorized access immediately to

4. Acceptable Use Policy

Prohibited Activities

  • Using the Services for any illegal purposes or activities
  • Attempting unauthorized access to systems or data
  • Bulk scraping or excessive automated queries beyond API limits
  • Overloading or disrupting service infrastructure
  • Redistributing breach data without explicit permission
  • Automated abuse or circumventing rate limits
  • Impersonating other users or entities
  • Uploading malware, viruses, or malicious code
  • Violating privacy rights of individuals or organizations
  • Reselling or white-labeling services without authorization

5. API Usage Terms

Developers and partners using our API must adhere to the following:

  • Follow documented rate limits for your subscription tier
  • Do not attempt to circumvent rate limits or usage restrictions
  • Provide appropriate attribution when displaying breach data
  • Understand that API endpoints and formats may be modified with notice
  • Premium API features require active paid subscriptions
  • API keys must be kept secure and not shared publicly
  • Commercial use of API data requires appropriate licensing

6. Intellectual Property Rights

While portions of our source code are open-source and available on GitHub, the following are protected intellectual property:

  • Brand names, logos, and trademarks (xonPlus, XposedOrNot)
  • Breach database compilation and data aggregation methods
  • Proprietary algorithms and threat intelligence processing
  • Dashboard designs and user interface elements
  • Documentation, marketing materials, and content

7. Privacy and Data Handling

Our Privacy Commitments

  • We never sell personal information to third parties
  • Search queries are not stored identically or linked to users
  • Email subscriptions require storage for alert functionality
  • Domain monitoring serves legitimate organizational security needs
  • All data is encrypted in transit (TLS 1.3) and at rest (AES-256)
  • We comply with GDPR, CCPA, and relevant data protection regulations

8. Accuracy Limitations and Disclaimers

Important: Please understand the following limitations:

  • Absence of breach results does not guarantee your data is safe
  • We report only publicly disclosed breaches we have access to
  • Breach data may be incomplete, delayed, or contain inaccuracies
  • Not all breaches are discovered or reported immediately
  • Our Services should not be your sole security measure
  • We cannot prevent breaches, only notify you of exposures
  • Historical breach data may have gaps or missing information

9. No Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Continuous, uninterrupted service availability
  • Complete detection of all data breaches
  • Accuracy or completeness of breach information
  • Prevention of future security incidents
  • Compatibility with all systems or platforms
  • Meeting specific security or compliance requirements

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service outages, delays, or interruptions
  • Inaccuracies or errors in breach data or alerts
  • Actions taken based on information provided by the Services
  • Unauthorized access to or alteration of your data
  • Damages arising from third-party services or integrations

Our total liability under this Agreement shall not exceed the amount paid by you for the Services in the preceding 12 months.

11. Subscription and Payment Terms

  • Subscriptions are billed monthly or annually based on your selected plan
  • Pricing is transparent and displayed before purchase
  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • Payment is required at the beginning of each subscription period
  • We provide 30 days notice for any price changes to existing subscribers
  • Failure to pay may result in suspension or termination of access

  • New subscribers are eligible for a full refund within 30 days of their initial purchase

  • Refunds are processed within 5-7 business days to the original payment method
  • After the 30-day guarantee period, subscription fees are non-refundable

11.1. Lifetime Deal Terms

Lifetime Access Purchases

Lifetime Deal (LTD) licenses are available through authorized third-party platforms. These licenses grant access to xonPlus services under specific terms that differ from standard subscriptions.

Definition of "Lifetime Access"

  • "Lifetime" refers to the lifetime of the xonPlus product, not the lifetime of the user
  • Access is granted as long as the Services remain operational and commercially viable
  • We commit to providing reasonable notice (minimum 90 days) if discontinuing the Services
  • Lifetime access does not guarantee access to all future features or premium add-ons
  • Core functionality as described at time of purchase will be maintained for LTD users
  • LTD licenses are subject to the same Acceptable Use Policy as regular subscriptions

Fair Use Policy for LTD Accounts

To ensure service sustainability for all users, LTD accounts are subject to fair use limitations:

  • API Rate Limits: LTD plans have tier-specific monthly API call limits (as specified in your plan tier)
  • Monitoring Limits: Email and domain monitoring slots are limited per plan tier
  • Storage Limits: Report history and data retention may be limited compared to enterprise plans
  • No Commercial Resale: You may use the service for your business, but cannot resell monitoring services to third parties
  • Reasonable Usage: Excessive usage that impacts service performance for other users may result in temporary throttling
  • Support Access: LTD users receive standard email support; priority support requires upgrade to premium plans

Specific limits for each LTD tier are documented in your plan details and purchase confirmation.

No Resale or Transfer Policy

  • LTD licenses are non-transferable and non-resalable
  • You may not sell, transfer, or assign your LTD license to any other individual or entity
  • Account sharing or credential distribution violates this Agreement and may result in immediate termination
  • Only the original purchaser is authorized to use the LTD license
  • Business transfers (M&A, acquisitions) require written approval from
  • Unauthorized resale discovered will result in immediate license revocation without refund

Refund Policy for Lifetime Deals

  • 60-Day Money-Back Guarantee: LTD purchases are eligible for a full refund within 60 days of purchase
  • Refunds must be requested through the original platform where the purchase was made
  • After the 60-day period, LTD purchases are non-refundable
  • Refund processing times depend on the partner platform's policies (typically 5-10 business days)
  • Upon refund, your account access will be immediately terminated
  • Abuse of the refund policy (repeated purchases and refunds) may result in permanent ban

License Limitations

  • Each LTD license is limited to a single account and cannot be split or shared
  • Multiple license purchases cannot be combined or stacked to increase limits
  • Each license purchase creates a separate account with the tier limits specified at time of purchase
  • License upgrades between tiers may be available subject to platform policies

Feature Access and Limitations

LTD plans include core features with certain limitations compared to enterprise subscriptions:

  • Included Features: Email breach monitoring, domain monitoring, API access, automated alerts, dashboard access
  • Feature Updates: Access to features included in your tier at time of purchase
  • New Features: Major new features may be added to higher tiers or offered as paid add-ons
  • Grandfathering: Existing features in your plan tier will remain accessible
  • Enterprise Features: Some advanced features (SSO, custom integrations, dedicated support) remain exclusive to enterprise plans
  • API Changes: We may modify API endpoints with 90 days notice and migration documentation

Service Changes and Grandfathering

  • We will make reasonable efforts to maintain features available in your LTD plan at time of purchase
  • If we must discontinue a feature, we will provide 90 days notice and offer suitable alternatives
  • Plan limits (API calls, monitoring slots) will not be reduced from your original purchase terms
  • Price changes to subscription plans do not affect existing LTD users
  • We may offer LTD users upgrade paths to higher tiers or subscription plans at discounted rates
  • Migration to subscription plans is optional; LTD access remains valid unless you choose to upgrade

Termination Rights for LTD Abuse

We reserve the right to suspend or terminate LTD accounts that violate our terms:

  • Fair Use Violations: Excessive usage beyond reasonable limits may result in throttling or suspension
  • Abuse Patterns: Automated abuse, scraping, or circumventing rate limits will result in immediate termination
  • Resale Detection: Unauthorized resale or account sharing leads to permanent license revocation
  • Illegal Activities: Using the service for illegal purposes results in immediate termination
  • Warning System: Minor violations may receive warnings before termination; serious violations result in immediate suspension
  • No Refund on Termination: Accounts terminated for terms violations are not eligible for refunds

12. Service Availability and Maintenance

We strive to ensure high availability of the Services but do not guarantee uninterrupted or error-free operation.

  • Emergency maintenance may be performed without prior notice
  • Service status is available on our status page (Freshping)
  • External factors beyond our control may affect service availability
  • We will make reasonable efforts to minimize disruptions
  • No compensation is provided for temporary service interruptions

13. Termination Rights

User Termination:

  • You may close your account at any time through account settings
  • Cancelled subscriptions remain active until the end of the billing period
  • You can export your data before account closure

Our Termination Rights:

  • We may suspend accounts that violate these terms
  • We will provide notice before termination when possible
  • Serious violations may result in immediate account suspension
  • Upon termination, your access will be immediately revoked

14. Third-Party Services and Links

Our Services may contain links to third-party websites, services, or integrations. Please note:

  • We are not responsible for third-party content, accuracy, or availability
  • Third-party services have their own terms and privacy policies
  • We do not endorse or guarantee third-party services
  • Integration issues with third-party services are not our responsibility
  • Use of third-party services is at your own risk

15. Community Contributions and Open Source

We welcome and appreciate community contributions to our open-source components:

  • Contributors retain ownership of their contributions
  • By contributing, you grant us a perpetual, royalty-free license to use your contributions
  • Contributions must comply with our code of conduct
  • We may modify or incorporate contributions into the project
  • Contributors are credited in project documentation

If you have any concerns or disputes regarding the Services:

17. General Legal Terms

  • Assignment: We may assign our rights; you may not assign yours without our consent
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Entire Agreement: These terms constitute the entire agreement between you and us
  • Governing Law: This Agreement is governed by the laws of India
